  • Scope of Application

These General Terms and Conditions apply to all offers, reservations, and contracts for accommodations rented through “Fairness Circle”, a registered Association in Austria.

  • Definitions
  • Accommodation Provider: A natural or legal person providing accommodation to guests for payment, in general this is “Fairness Circle”, unless specified otherwise.
  • Guest: A natural person utilizing the accommodation services. Generally, the guest is also the contractual partner. Guests include accompanying persons (e.g., family members, friends, etc.).
  • Contractual Partner: A natural or legal person, domestic or foreign, entering into an accommodation contract as a guest or on behalf of a guest.
  • Accommodation Contract: The agreement between the Accommodation Provider and the Contractual Partner, which is detailed in these conditions.
  • Property / Accommodation: The accommodation or property rented by the provider to the contractual partner under the application of these terms and conditions.
  • Conclusion of the Contract – Deposit

The accommodation contract is concluded when the provider accepts the booking request of the contractual partner. Electronic declarations are considered received if they can be accessed under normal circumstances during the provider's business hours.

If a deposit is required, the contract is only finalized when the contractual partner agrees to pay it. The deposit is part of the total agreed Piment.

  • Prices

You are obligated to pay the price indicated in the written booking confirmation. Discounts or special offers cannot be applied after the reservation confirmation has been issued.

All prices include VAT, if applicable, unless otherwise specified. If VAT increases after the contract conclusion and the trip starts more than four months later, the price will increase proportionately.

  • Start and End of Accommodation

The contractual partner has the right to occupy the rented rooms and properties from 3:00 PM on the agreed arrival day unless otherwise specified. Rooms and properties must be vacated by 11:00 AM on the departure day. Failure to vacate on time may result in additional charges.

  • Payments and Deposit
  • A minimum of 50% deposit of the total amount is required upon reservation. The remaining amount must be paid no later than 30 days before the stay begins.
  • For reservations made within four weeks of the stay, the full amount is due immediately. Failure to pay may result in cancellation of the reservation and liability for damages.
  • A deposit of up to €900 per property may be required in cash or by preautorisation of the credit card at the start of the stay and will be refunded upon departure, provided there is no damage.
  • Withdrawal from the Accommodation Contract
  • By the Accommodation Provider: If the deposit is not paid on time, the provider may withdraw without notice. The provider can also cancel the contract up to three months before the agreed arrival date for justified reasons.
  • By the Contractual Partner: Free cancellations are allowed up to 30 days before arrival. After that, cancellation fees apply, varying by property and season (e.g., up to 100% for last-minute cancellations).
  • Fair Use Policy

Pets are not allowed in any managed property of our accommodation providers. Children from the age of 14 and above are welcome. Guests are kindly requested not to use the property as a party house. The contractual partner is liable for any damages incurred. All properties are non-smoking zone.

The contractual partner confirms to comply with the property’s rules and takes full responsibility for any damages resulting from the disregard of the property’s rules.

  • Rights of the Accommodation Provider

The provider has the right to withhold guest belongings as collateral if payments are delayed. They may also charge interim invoices during the stay.

  • Obligations of the Accommodation Provider

The provider must deliver the agreed services to the standard specified. Additional services, such as providing beverages or extra beds, may incur separate charges.

  • Limitation of Liability

The provider is not liable for minor negligence. Liability for indirect or consequential damages and lost profits is excluded.
